The purpose of these General Terms and Conditions of Use (hereinafter referred to as "GTCU") is to regulate in detail the use of the website of Zyntern.com Kft. (registered office: 8000 Székesfehérvár, Had utca 1-3. 315., company registration number: 07-09-028850, tax no: 25776641-2-07), as a service provider (hereinafter referred to as "Service Provider"), the terms and conditions for the provision of the online job advertisement and job search engine service, and the terms and conditions between the Service Provider and the customer of the service, i.e. the job advertiser (hereinafter referred to as "Customer"; the legal relationship between the Service Provider and the Customer, hereinafter referred to as the "Parties", and collectively as the "Parties"), the obligations and rights of the Parties, and the rights and obligations of the system operated by the Service Provider and of the customers, i.e. job seekers (hereinafter referred to as the "Customer") who do not use the service as a Customer.
1.1.1.1. Customer: this term is defined in clause 1.
1.1.2. Service: all services provided by the Service Provider within the scope of these GTCTC, whether to the Customer or to the Customer.
1.1.3. Provider's Website: www.zyntern.com
1.1.4. Customer: this term is defined in Section 1.
1.2.The issues not regulated in the GTCTC and the activities of the Service Provider shall be governed by the applicable Hungarian laws and regulations and provisions of the authorities in force at the time. The contract concluded on the basis of these GTCF shall be deemed to be a contract concluded by electronic means, which shall be governed by Act V of 2013 on the Civil Code, Act CVIII of 2001 on certain issues of electronic commerce services and information society services. The contract does not constitute a written contract, the circumstances of the conclusion of the contract (exact date, details of the parties, statements made) are recorded in the electronic system of the Service Provider and these data can be retrieved from there at any time. The language of the contract is Hungarian.
1.3. Publication and amendment of the GSPC
1.3.1 By registering on the Service Provider's Website, the Customer or the Client accepts the GTCTC, thus the contract between the Parties is concluded. By accepting the GTCTC, the Customer or the Client also acknowledges that the Service Provider is entitled to unilaterally modify the terms and conditions of the GTCTC, in whole or in part, at any time. The amended GTCTC shall be published by the Service Provider on the Service Provider's Website in a prominent place at least 15 (fifteen) days prior to the entry into force of the amendment.
1.3.2.The Service Provider shall be entitled to unilaterally amend the GTCTC, in particular in cases where changes in economic circumstances or in circumstances related to the provision of the Service, such as, in particular, market demands for the development of the Service, changes in the material conditions of the Service or changes in the operation of the Service Provider, justify such amendment. The Customer or the Client shall be deemed to have accepted the amendment to the GTCF if he continues to use the Service after the entry into force of the amendment to the GTCF. The current and previous version of the GTCF is available on the Service Provider's Website.
1.4. Scope of the GTCF
1.4.1 The GTCF shall enter into force upon publication, and any amendments thereto shall enter into force on the date specified therein, but not earlier than the fifteenth (15th) day following the publication pursuant to clause 1.3.2. The GTCF shall remain in force for as long as the Service Provider provides the Service. The scope of this TOSFF covers the Customer, the Service Provider and the Client.
2.1 Within the framework of this GTCTC, the Service Provider operates a special online job advertisement and job search portal and provides the following Service:
2.1.1.Within the framework of the Service, the Service Provider shall operate an online system in which the Customer may upload/publish job advertisements, with detailed recording of the skills and qualifications required by the Customer as an employer or other employer/client of the Customer, and the skills and qualifications required for the job, as well as other circumstances related to the job advertisement. The Service follows the principle of "one advertisement for one specific position", i.e. each advertisement published is for a specific position, ensuring that the jobseeker applies for the specific position that is relevant to him/her. Individual advertisements must not contain references to other advertisements or for database (talent pool) building purposes.
2.2 The Service also allows for the publication of events by the Customer, with a detailed description of the event. The registration for events can be made, at the Customer's choice, either on the Zyntern.com website in a similar way to the registration for job advertisements, or on an external interface, to which the online system operated by the Service Provider provides a link. If the registration is made on an external interface, the Customer clicks on the link to be redirected to the external interface, which is subject to the Customer's terms of use and data management policies.
2.3. In parallel, the jobseeking Client shall create his/her own profile during the registration process, on which he/she shall indicate in detail his/her skills, qualifications and other relevant aptitudes and facts.
2.4 The Job Seeker Client can search and browse the job and event listings uploaded by the Customers on the main page of the website without any restrictions, however, without registering and creating a profile, the Job Seeker Client cannot benefit from the advantages of the system, which are:
2.4.1 The Service Provider shall use the software it operates (the "Software") to analyse and compare the preferences and criteria set out in the profile provided by the Customers during their registration and the data provided by the Customers, and shall indicate the match to the Jobseeker Customer in case of a match. In other words, the Service Provider will filter the data in order to display only the advertisements that appear relevant to the Jobseeking Customer.
2.4.2.When indicating the results, make the Customer's job advertisement available to the Customer in its entirety.
2.5. Customers have the opportunity to apply for the job advertisement when the results are displayed. To apply, the Customer must (i) register their profile on the Service Provider's Website, (ii) accept these GTC and (iii) the Service Provider's Privacy Policy, and then click on the "Apply" button that appears in relation to the job advertisement. By applying, the Client automatically consents to the Client's access to all the data uploaded by the Client, to the Client's complete profile and to the processing of the data in connection with the job advertisement to the extent necessary within the limits set out in the Service Provider's Privacy Policy.
2.6 The Client's application will be indicated in the results displayed on the Client's site, i.e. the Client's page will show that the given result, i.e. the given Client, has applied for the job advertisement. The Customer will be shown a result with reduced information content. The reduced information contains the following data: [Client's name, Matching expectations, Non-matching expectations, Student status, Education, Professional experience].
2.7 The Client, after the Client has applied for the position advertised by the Client, has the possibility to view and download in pdf format the Client's application form as per 2.6 for a period of 90 days. The Client's e-mail address and telephone number will only be visible to the Client if the Client provides positive feedback to the candidate.
2.8 The Client may use the Client's profile data only within the scope of its own operations, in connection with the purpose of the job advertisement, and may not disclose them to the public or disclose them to third parties or make them available to third parties without the Client's prior written consent.
2.9 In addition to the above, the Service Provider provides the following sub-services:
2.10.1 An ever-evolving and expanding form to support the entry of skills, qualifications and other information.
2.10.2 Ensuring the editing of the data sheets and profiles provided.
2.10.3 The Customer has the possibility to download his own data sheet with the currently filled in data in pdf format.
2.10. The Service Provider shall display the job advertisements on the Service Provider's Website for 30 (thirty) days from the date of upload.After 30 (thirty) days, provided that the Customer does not take any action to extend the job advertisement in the manner provided by the system, the Service Provider shall set the job advertisement to "archived" status. The Customer may activate the job advertisement at any time, provided that he has an advertising balance and is entitled to archive and delete it himself. If the job advertisement is cancelled by the Customer or the Service Provider as defined in these GTCTC, the Service Provider shall continue to store the job advertisement in its database with the status of cancelled.
2.10.1 The Customer has the possibility to store active (published), saved and archived advertisements within his profile.
2.1.1. Active (published) advertisements
2.10.2 The content of active, i.e. published advertisements can be viewed by Customers visiting the website without registration.
2.10.3 Active advertisements may be modified, withdrawn or archived by the Customer at any time.
2.10.4 The Customer can only publish or republish advertisements if it has an available advertising balance.
2.10.5. 3.1.2. Saved, Archived advertisements
2.10.6 Saved and archived advertisements can only be viewed by the Customer in his/her profile.
2.10.7 You can only post saved or archived ads if you have an available ad balance.
3.1 Information on the packages available for ordering is available on the current pricing page. The Customer may choose from the following advertising options:
3.2. Zyntern Trial - 1 free advertisement for 1 position - The Customer may run 1 free 15-day advertisement (Zyntern Trial) for 1 position, which may be archived at any time, but with the understanding that he/she may not place another free advertisement within 60 days of posting. In the case of a free ad, the system will accept the first 2 applications, after which the ad will be inactivated. If the Customer wishes to accept additional applications, he can do so by switching to the Zytern Pro package.
3.3. Zyntern Pro and Unlimited Ads - If the Customer wishes to place more ads (more positions) in addition to the Zyntern Trial free ads, he/she must pay for them, i.e. have a balance. You must pre-order Zyntern Pro ad packages or unlimited monthly/annual subscription by logging into your profile via the pricing page. For Pro advertising, the system will accept unlimited applicants for the ad. In case of a Pro advertisement, the Customer has the option to redirect candidates to their own external interface (e.g. their own career site). In case of a Pro advertisement, the Customer has the option to specify one or more filtering questions that the candidate must answer when applying.
3.4. Zyntern Pro event - 1 ad per event - You must pre-order Zyntern Pro event advertising services by logging into your profile via the pricing page.
3.5. Highlighted advertisement The Customer has the possibility to highlight the advertisement of Zyntern Pro on the main page for 15 days. In this case, you will have to purchase a featured package.
3.6. The Customer can see in his profile the balance of the Customer and its expiry date.
4.1.1 The Customer is required to provide his/her e-mail address (which will be used to identify the Customer in the future) and a password associated with the e-mail address during registration. If the e-mail address has already been used for registration or the password is already taken, the system will indicate this and the Customer will be required to provide a different e-mail address or password. The Customer also has the possibility to identify himself by his registration with another service provider (Facebook) by clicking on the corresponding link during registration. The Customer is obliged to keep his password secret, and the Service Provider is not responsible for any unauthorised persons obtaining the Customer's password through no fault of the Service Provider.
4.1.2 The Customer shall be entitled to register on the Service Provider's Website only upon acceptance of the terms and conditions set out in this GTCTC and the Privacy Policy, and after acceptance. Acceptance must be indicated by ticking the appropriate check boxes.
4.1.3 The Customer acknowledges that if he/she is under the age of 14, he/she may only be registered by his/her legal representative under Act V of 2013 on the Civil Code (hereinafter referred to as "Civil Code"). A minor who has reached the age of 14 but has not yet reached the age of 16, as well as a Customer who is otherwise of limited capacity, may give consent to the processing of data with the consent or subsequent approval of his/her legal representative. A Customer who is a minor over the age of 16 may give consent on his or her own, without the need for the consent or subsequent approval of his or her legal representative. For more information on this, please see the relevant provisions of the Privacy Policy.
4.1.4 Following registration, an automatically generated e-mail will be sent to the e-mail address provided by the Customer, informing the Customer of the registration and how to activate the registration. The registration will only become active after confirmation of the registration based on the notification sent to the e-mail address provided, therefore it is important that the Customer provides his/her real e-mail address to which the Customer has access.
4.1.5 After registration, the Customer's own profile is created, in which the Customer can store his/her skills, qualifications and other data as detailed below, as well as perform the following operations and use the services.
4.2.1 In the Customer profile created during registration, the Customer may enter and store the following data about himself/herself:
4.2.2. Personal photos (profile and cover)
4.2.3. Contact Details/Personal Data: the Customer's data necessary to contact him/her;
4.2.4 Job details, expectations: the requirements and needs of the Client for the prospective job (type of job, job specialisation, preferred location, working hours)
4.2.5 Skills: the skills of the Client that may be relevant to employers; all the knowledge and experience that the Client has accumulated in the course of his/her activities and that may be relevant to the job search (Language, IT, Professional and Soft Skills)
4.2.6. Education and certificates: educational qualifications, certificates and documents obtained by the Customer to date;
4.2.7. Professional experience: a brief free-text description of the Client's previous professional experience, the tasks he/she has performed, the positions he/she has held.
4.2.8. interests, hobbies: the activities that the Customer carries out in his/her free time;
4.2.9 The Customer may only provide personal data in his/her profile and may only upload a photograph of himself/herself. The Customer is responsible for the accuracy, veracity and timeliness of the information provided. The Customer further warrants that the data and photographs uploaded by him/her do not infringe or restrict the personality rights, copyright or other proprietary rights of any other person or company. The Client shall be liable for any damage resulting from the infringement of the above, whether to the Service Provider or to third parties.
4.2.10. The Customer may modify his/her data at any time, both during registration and afterwards in the Edit Profile menu. If the Customer has already registered but does not remember the password provided at the time of registration, the Customer can request the Service Provider to send a new access password to the e-mail address previously provided during registration by clicking on the "Forgot password?" button after clicking on the "Request new password" button. You can change the password in the "Change password" section of the Edit profile interface.
4.2.11. Customer profile statuses The Customer has the right to change the status of his/her personal profile at any time as follows
4.2.12. Active status: in this case, the data uploaded by the Client, in case of application for a job, are available to the Client after a positive feedback from the Client.
4.2.13. Inactive status: in this case, the data uploaded by the Customer is not accessible, searchable or visible to other Customers or Customers. After sixty months of inactive status, the Service Provider will send a reminder email to the Customer to confirm his registration, otherwise the Customer's profile will be deleted.
4.2.14. The Customer may delete his/her profile at any time by clicking on the "Delete Profile" button.
4.2.15. If the Customer does not log in for sixty months, the Service Provider will send a reminder email to confirm the registration, otherwise the Customer's profile will be deleted.
4.2.16. The Service Provider will send the registered Customer an immediate notification of all the positions corresponding to his preferences and settings within his Zyntern.com profile (notification).
4.2.17. The Customer has the option to receive notifications from the Service Provider to the e-mail address provided, on the following two topics, provided that the Customer has set this function and the frequency of sending on his/her profile page in the "Settings" menu:
4.2.17.1. "Notify me by email of new jobs that suit me"
4.2.17.2 "Notify me by email of successful and unsuccessful applications"
4.2.18. The Customer may opt-out of the email notifications referred to in Clause 4 at any time via the Profile page under Settings.
4.2.19. The Customer may also unsubscribe from the email notifications set out in Section 4 directly from the email received by clicking on the "Unsubscribe" button, in which case the Customer will be redirected to the "Settings" menu of his/her profile, where he/she can deactivate the notifications with a single click.
4.2.20. The Client has the possibility to subscribe to the Service Provider's newsletter at the time of registration. This must be specifically ticked at the time of registration. In this case, the Service Provider may send the registered Customer informative e-mails about the latest news of the Service, information and events concerning the Service to the e-mail address provided, to which the Customer consents by registering.
4.2.21. At the same time, the Customer may, at any time, indicate that he/she no longer wishes to receive information about news, events and information concerning the Service by using the unsubscribe button at the end of the email sent by the Service Provider.
4.2.22. By registering, the Customer automatically consents to being contacted directly by the Customer concerned with the application, and to being contacted directly by the Customer at the contact details provided by the Customer.
4.3.1.The Customer may browse the public job advertisements available to anyone without registration.
4.3.2.The Customer may also access information and notices available on the Service Provider's Website without registration.
5.1.1 In order to share a job advertisement, the Customer must (i) register on the Service Provider's Website, (ii) accept these GTC and (iii) the Privacy Policy and (iv) create a company profile by clicking on the "Publish" button.
5.1.2 Registration requires the complete completion of the registration form on the registration interface. Data required for registration: company name, email address, password.
5.1.3 A legal entity may (unless otherwise agreed) have only one company profile on which it advertises. If a legal person advertises on more than one profile, the Service Provider is entitled to deactivate the company profile and request the legal person to choose the only profile it wishes to use.
5.2.1.The Customer shall fill in his company profile prior to the posting of job advertisements. The Customer may publish the company profile in several languages.
5.2.2.The Customer shall be solely responsible for the data and content provided during registration and completion of the company profile.
5.2.3.The Customer can modify his/her data at any time, both during registration and afterwards in the Edit Profile menu. If the Customer has already registered, but does not remember the password provided at the time of registration, he can request the Service Provider to send a new access password to the e-mail address previously provided during registration by clicking on the "Forgot password?" button after clicking on the "Request new password" button. You can change the password in the "Change password" section of the "Edit profile" interface
5.2.4.In order to post a job advertisement, the Customer must publish his/her profile by clicking on the "Publish" button.
5.3.1.The Customer has the option to deactivate, i.e. hide, his/her profile. In this case, for the duration of the deactivation, the Customer will not receive any notification of users applying for jobs either within his profile or by e-mail. Once you have deactivated your profile, your profile will not be visible on the Zyntern.com website for the duration of the deactivation.
5.3.2.The Customer may reactivate his/her profile if he/she wishes to use the Services again.
5.4.1.The Customer has the possibility to delete his/her Profile if he/she no longer wishes to use the services of Zyntern.com. In this case, all data of the Customer will be deleted from the database and the Customer will no longer be able to log in to his/her account. In this case, if you wish to advertise again, you will have to re-register.
6.1 The Service Provider shall provide the Service to registered Customers and Clients in accordance with the provisions of these GTCTC.
6.2 The Service Provider shall not be liable for the content, truthfulness, or any acts or omissions of the Customer or the Client in relation to the data, information, job advertisements, materials uploaded by the Customer or the Client, nor shall the Service Provider be obliged to verify, correct or remove any data, information, photographs uploaded by the Customer or the Client. However, the Service Provider reserves the right to delete the profile or registration of a Customer or Client if it is proven that the Customer or Client has provided false information.
6.3 The Service Provider shall also be entitled to check the content of job advertisements uploaded or intended to be uploaded by the Customer and of data sheets uploaded or intended to be uploaded by the Customer at any time. If the content of a particular job advertisement or the Customer's data sheet is contrary to these GTC, the law, morally questionable, misleading or, in the opinion of the Service Provider, unacceptable for any other reason, such as a violation of the "one advertisement one position" principle, on the Service Provider's Website, in that case, the Service Provider shall be entitled to refuse to post the job advertisement or to post the Client's profile or individual content elements thereof, and to delete the job advertisement, profile or individual content elements thereof from the Service Provider's Website, or to delete the registration of the Client or the Customer at its discretion. The Service Provider is obliged to notify the Customer or the Client of the refusal to upload or the deletion, but is not obliged to give reasons for its decision.
6.4.The Service Provider is entitled to delete the profile and registration of any Customer at any time, in particular in case of suspicion or proof of improper use, if the Service Provider considers that the Customer is not using the Service Provider's system or the service elements available to him/her for their intended purpose.
6.5 The Service Provider shall not be liable for any damage caused by force majeure or any other cause or event beyond the Service Provider's control, or for any damage caused to the Customer or the Client's interest or as a result of the Customer's or the Client's failure to comply with or delay in complying with the terms of the Contract or the GTCTC. The Service Provider shall not be liable for the quality of the Service even if the Customer or the Client does not use the Service as intended.
6.6 The Service Provider shall not be liable for any damage suffered by the Customer or the Client as a result of the Service Provider's right to provide the Service being withdrawn or modified in such a way that it is unable to fulfil its obligations under the GTCTC from that date. In this case, the provision of the relevant Service shall cease on the date specified in the decision to that effect.
6.7 The Service Provider shall not be liable for any damages suffered by the Customer or the Client in the use of the Service on behalf of any third party that may be involved in the provision of the Service, whether arising from normal operation or from any failure that may occur in the course of operation, nor for the quality of the services provided by such third parties (e.g. internet connection, banking connection, etc.). The Customer and the Client shall be entitled and obliged to claim damages directly from the third party that caused the damage.
6.8 Given the fact that the Customer may register in the system free of charge and may use the service elements provided to the Customer by the system free of charge, the Service Provider shall not be liable to the Customer for any other liability, whether in relation to the availability or quality of the service, and shall be exempt from any liability for damages to the Customer to the maximum extent permitted by law.
6.9 The Client further acknowledges that the Service Provider does not undertake any obligation to guarantee the success of the selection process, but only to provide a contact platform for job seekers. Therefore, the Service Provider shall not be liable in any respect if the Client fails to find a job despite using the services available on the Service Provider's Website.
6.10. The Customer acknowledges that the Service Provider does not have any representative, agent or proxy relationship with the Customer. The Service Provider shall not be liable for any damage that the Customer may suffer as a result of searching for a job, applying for a job or entering into employment in connection with the service available on the Service Provider's Website or with the help of the Service Provider's Website. If the Client concludes an employment contract or otherwise enters into an employment relationship with a Customer (employer), it does so without the Service Provider acting as an intermediary. The Service Provider shall not be liable for any promises made by the Client (employer) to the Customer, nor for the fulfilment of the terms of the employment contract or other contract.
6.11. Both the Customer and the Client acknowledge that the placement of their (personal/company) data on the Service Provider's Website and its database does not grant them any copyright in relation to the database. However, under the terms and conditions of this GTCTC, he/she is entitled to modify, supplement, update or delete his/her (personal/company) data placed in the database.
6.12. The Service Provider shall be entitled to modify or terminate the Services available on the Service Provider's Website at any time without prior notice. In the event of termination without prior notice, the Service Provider shall be obliged to settle accounts with the Customer, in which case the Customer may only claim reimbursement of the fee for the pro rata period, and the Service Provider shall exclude any other claims for damages.
6.13. The Service Provider shall not be liable for any damage caused to the Customer or the Customer or any other person using or intending to use the Service (collectively referred to in this clause as "Users"), either for:
6.13.1. the Users do not comply or do not contractually comply with the provisions of the GTCTC;
6.13.2. the Users are in default or in error;
6.13.3. for reasons beyond the control of the Service Provider, the use of the Service is prevented or not properly carried out;
6.13.4. the Service Provider unilaterally modifies the terms and conditions of this GTCTC; and/or
6.13.5. any other person commits any misuse of the Service at the expense of the Customer or the Client.
6.14. Customer service
6.14.1 The Service Provider shall operate an electronic (e-mail) customer service to meet the needs related to the Service, to report errors and to provide the Customers and Clients with appropriate information and information related to the provision of the Service, and to provide appropriate information and advice.
6.14.2 The Customer and the Client may report any errors detected in connection with the Service to the Service Provider's customer service by e-mail. The e-mail address of the Service Provider's electronic customer service is [email protected].
6.14.3 The Service Provider shall investigate all notifications and complaints and inform the Customer or the Client in accordance with the provisions of the law. The Service Provider shall keep records of the notifications, complaints and investigated incidents.
6.14.4 The Service Provider shall take measures to correct the defect notified by the Customer, which has been proven to be real as a result of the inspection and which has arisen in the interest of the Service Provider, within a reasonable period of time.
6.15. Information
6.15.1.The Service Provider shall inform the Customer and the Client of all relevant circumstances relating to the provision of the Service, in particular any changes to the Service, the territorial extension of the Service, new services, their use, charges and changes thereto.
6.15.2.The Service Provider shall publish on the Service Provider's Website any information relating to the provisions of this GTCTC or any other information concerning the Customer or the Client.
6.15.3.The Service Provider may send information concerning the provisions of these GTCTC or other information concerning the Customer or the Client by sending a message or e-mail to the telephone number of the Customer or the Client (if provided during registration).
7.1 The Customer shall pay a fee for the use of the Service as set out in the Schedule of Charges issued by the Service Provider (hereinafter referred to as the "Fee"). The Customer may pay the Fee as follows:
7.1.1.Based on the fee for the services ordered by the Customer, the Service Provider shall issue a fee invoice, which shall be sent electronically to the Customer. The Customer is obliged to pay the amount indicated on the fee invoice by bank transfer. When making the bank transfer, the reference number of the transfer on the fee application must always be indicated in the comment field.
7.1.2.Upon receipt of the service fee to the Service Provider's account, the Service Provider shall credit the advertising credits to the Customer's profile and issue a final invoice, which shall be sent electronically to the Customer.
7.1.3.The Service Provider shall issue an invoice for the Services provided for the period of time specified in the Agreement.
7.1.4.The Customer may request that the invoice issued by the Service Provider be sent to him by post or electronically at monthly intervals.
7.1.5.The Customer, the Client and the Service Provider are obliged to cooperate with each other in their contractual relationship under the GTCTC.
7.1.6.The Customer and the Client both warrant that no data contrary to law, morally unacceptable or otherwise untrue in public opinion will be uploaded or attempted to be uploaded to the Service Provider's Website.
7.1.6.1.The Customer further warrants that the data, photographs and videos uploaded by it do not infringe or restrict the personal, copyright or other protected rights of any other person or company, and in the case of close-ups, that they have the consent of the persons concerned. The Customer shall be liable for any damage resulting from the infringement of the above, whether to the Service Provider or to third parties. The Service Provider excludes any liability for unlawful content, such claim shall be fully enforceable against the Customer in the event of a claim against the Service Provider.
7.1.7 The Customer shall, if possible, delete within a reasonable period of time any job advertisements which for any reason (e.g. because the position has been filled) are no longer current.
7.1.8 The Customer and the Client shall be liable to pay compensation for any damage resulting from any use in breach of these GTC.
7.2 The Customer may also fulfil his obligation to pay the fee by online payment by credit card. Online credit card payments are made through the Barion system. The credit card details are not transmitted to the merchant. The service provider Barion Payment Zrt. is an institution under the supervision of the Hungarian National Bank, licence number H-EN-I-1064/2013. Barion's General Terms and Conditions are available at the following link: https://www.barion.com/hu/altalanos-szerzodesi-feltetelek/ The Customer acknowledges that Barion's General Terms and Conditions are determined without the Service Provider's involvement and that Zyntern has no influence on their development.
8.1 The legal relationship shall be terminated by the death or legal dissolution of the Customer or the Client, or by the legal dissolution of the Service Provider.
8.2 The legal relationship shall be terminated upon cancellation of the registration, with the proviso that the Parties and the Client shall remain liable for their conduct and actions during the period until termination, regardless of the termination, and the Parties and the Client shall continue to be bound by their confidentiality obligations after termination.
9.1. Intellectual property
1.1.1.1.1.1. the Service Provider's Website, all intellectual property (including but not limited to: its graphic elements, image, layout) and all content (including but not limited to: the entirety of job advertisements and CVs placed on the Service Provider's Website as a database) available on the Service Provider's Website, as well as the software and IT system operating the Service provided by the Service Provider, are the property of the Service Provider, and may be used in any way whatsoever only with the prior permission of the Service Provider and as defined in these GTCF, within the limits of these GTCF. Intellectual property under this clause is protected by law and its use may give rise to civil and criminal penalties.
9.1.1.The Service Provider's Website is protected by copyright in its entirety, and it is prohibited to cut out any part of it or to publish the mutilated part, including making it available to the public.
9.1.2 It is forbidden to mirror the content of the Service Provider's Website, i.e. to republish it by means of technical operations, even in unchanged form.
9.1.3 The domain name zyntern.com and the name of the Service Provider may be protected by copyright, except for references, only with the express prior written consent of the Service Provider.
9.2 The Service Provider and the Customer shall endeavour to settle any disputes arising from the legal relationship between them without recourse to litigation, taking into account each other's interests at all times. The natural person Customer shall be entitled to apply to the conciliation body of his place of residence or domicile. Failing this, the jurisdiction of the conciliation body shall be established by the seat of the enterprise concerned by the dispute or the body authorised to represent it (Budapest Conciliation Board; postal address: 1016 Budapest, Krisztina krt. 99.). If the amicable settlement of the dispute between the parties does not lead to a result, the Service Provider and the Customer submit to the exclusive jurisdiction of the Budapest II and III District Court for the settlement of all disputes between them.
9.3.In matters not regulated in the GTCTC, Act V of 2013 on the Civil Code and other applicable provisions of Hungarian law shall prevail.
9.4 The Service Provider shall publish the GTCTC on the Service Provider's Website.
9.5 Unless otherwise provided for in the GTC, the Service Provider shall be entitled to send any notice in connection with the GTC to any contact details (address, registered office, e-mail address, telephone number) provided by the Customer or the Customer and recorded by the Service Provider. If there is a change in the Customer's or Client's contact details, the Customer or Client shall be obliged to update them. As long as the Customer or Client does not notify the Service Provider of a change of information, notifications sent to the address recorded with the Service Provider shall be deemed to have been delivered. The Service Provider shall notify the Customer and the Client of changes to the GTCF by publication on the Service Provider's Website, otherwise as provided in clause 1.4.2.
